A webinar presented by the IBA Professional Ethics Committee, supported by the IBA Criminal Law Committee
Ethics are paramount in criminal justice and the goals of international trials are broader and more political than those of domestic trial, yet existing codes of conduct fail to take into account these special features of the international criminal justice system. Criminal courts are thus faced with an obstacle inherent to the very idea of ethics: the impossibility of defining what constitutes ‘ethical conduct’ divorced from one’s culture, tradition, legal system or professional background.
Even when rules are codified, they often remain open to divergent interpretations depending on one's cultural, social, and legal background. Ultimately, it is not simply a matter of codifying ethical rules but, more importantly, of agreeing on ‘whose ethics’ these rules should reflect. As attorneys decide how to balance their duties to their clients and to the court, they are generally left to act according to their own diverse domestic traditions.
Our panel of legal experts will explore the ethical dilemmas and the complexity of defining ethical standards in international criminal proceedings, in the absence of precise written rules.
