Description

One of the most challenging tasks for anti-money laundering (AML) professionals is to uncover the identities of ultimate beneficial owners of legal structures and corporate vehicles, particularly those incorporated in offshore jurisdictions that require less transparency or tax havens, where the source of information can be limited and, in some cases, unreliable. This interactive and practical session will provide some tips that may be helpful in identifying beneficial owners of complex offshore entities with multiple layers of ownership, where each layer may be comprised of one or more corporate entities, where some of them may be different in type and incorporated in different jurisdictions, which may even include trust or private foundations. This session will also cover the lawyer's role in the formation process and the Financial Action Task Force (FATF)/government response in the creation of registers. How effective have they been in helping compliance/law enforcement and what do they mean for the privacy of individuals associated with corporates and trusts?
