Description
The year in review is filled with significant developments, covering: • the developing legacy of Achmea; • the United States-Mexico-Canada Agreement; and • the new Dutch Model bilateral investment treaties (BITs). In addition, we look at the conclusion of other new treaties, some of which follow a traditional approach and others that purport to eliminate investor-state arbitration, passing by the assessment of the UNCITRAL Working Group on investor-state dispute settlement reform and a review of investment treaty cases in the United Kingdom and Singapore courts.
