Description

How far should competition law reach beyond the boundaries of a given nation? Despite many decades of active enforcement of competition law against multinational actors and activities around the world, questions still abound regarding the proper limits of extraterritorial jurisdiction. Recent guidance from courts and enforcers in the EU (in the Intel case), US (in updated DOJ-FTC Guidelines for International Enforcement), Canada (in the E-books case), Japan (in the CRT case) and elsewhere have added to the debate, which this panel will examine.
