Description
Non-trial resolutions, formal and informal, are by far the dominant form of resolution of international bribery cases. Since the double jeopardy defence is not recognised by most jurisdictions in international corruption cases, companies and enforcement authorities face complex issues when they address prosecutions that can be brought in multiple jurisdictions. Cooperation between authorities in the finalisation of non-trial resolutions to resolve charges relating to bribery can be a way to avoid multiple, overlapping prosecutions in international corruption cases. This panel will discuss work currently underway in both the IBA’s Non- Trial Resolutions Sub-Committee and the OECD Working Group on Bribery to analyse and consider guidance on non-trial resolutions and cooperation among member states.
